These terms apply to the website at https://www.pigmentia.co and sales by Riga Group L.L.C., trading as Pigmentia. Business identity and contact information is set out in our Legal Notice.
1. Scope and mandatory rights
By using the website, you agree to the website-use provisions. A purchase contract is governed by the version presented when you order. Nothing in these terms excludes a consumer right or remedy that applicable law does not allow us to exclude.
2. Products and product information
We describe the principal characteristics, available formats, dimensions, materials, and price on the product page and at checkout. Please review the chosen artwork, type, size, frame, quantity, delivery country, and total before payment.
Screen settings can affect colour appearance, and handmade or natural materials can have reasonable variations. This does not excuse a product that is faulty, materially different from its description, or not of the quality required by law.
3. Personalised content
If you provide an image, name, text, or other material for a personalised order, you confirm that you have the rights and permissions needed for us to reproduce it for the order and that it is lawful. You retain ownership of your content and give us a limited licence to review, adapt, produce, and deliver the requested product.
We may reject content that appears unlawful, infringing, hateful, exploitative, or technically unsuitable. We will explain the decision and refund any amount paid for work we do not supply, subject to applicable law.
4. Prices, tax, and delivery charges
Prices are in euros. The final checkout states the merchandise price, delivery charge, discounts, and any tax that we collect before you confirm payment. Do not place the order if the total or tax treatment is unclear. Import taxes or carrier charges may be payable to local authorities as explained in our Shipping & Delivery Policy.
We may correct an obvious pricing or description error before accepting an order. If you already paid, we will ask whether you want to proceed at the correct price or receive a full refund; we will not charge a corrected amount without permission.
5. Checkout, payment, and contract formation
Stripe provides the embedded payment interface. Available payment methods appear in checkout. By activating the final payment control, you acknowledge that the order creates an obligation to pay the total shown.
Your order is an offer to buy. An automated receipt confirms that we received it; acceptance occurs when we send an acceptance or dispatch confirmation, unless mandatory law treats the contract as formed earlier. We may decline an order for genuine availability, legal, sanctions, fraud, payment, delivery, or pricing reasons. If payment was collected for a declined order, we refund it.
6. Production and delivery
Current destinations, costs, estimates, tracking, and import information are in the Shipping & Delivery Policy and form part of the order information. We will perform the contract within the agreed time or the period required by applicable consumer law.
Tell us promptly if an order has not arrived or arrives damaged. For consumer deliveries, risk normally passes when you or a person you nominate physically receives the goods.
7. Withdrawal, returns, refunds, and cancellations
Our Returns & Refunds Policy explains the statutory 14-day withdrawal process for eligible standard products, the limited exception for genuinely personalised or customer-specification goods, cancellation, return costs, refunds, and faulty goods. It forms part of these terms.
8. Legal conformity and complaints
We are responsible for supplying goods that conform to the contract and applicable law. EU consumers generally benefit from a minimum two-year legal guarantee for goods that are faulty or not as advertised. Local law may provide equal or stronger protection.
Send a complaint to info@pigmentia.co or through our order-support form, including the order number and issue. We aim to acknowledge it within 2 business days. This service target does not shorten any legal deadline or remedy.
9. Website and intellectual property
The website, brand, layouts, text, and artwork are owned by us or used under licence and are protected by applicable intellectual-property laws. Buying a physical print transfers ownership of that copy after full payment but does not transfer copyright or permission to reproduce, scan, resell copies, mint, distribute, or commercially exploit the artwork.
You may use the website lawfully for personal shopping. Do not interfere with security, scrape or copy the catalogue at scale, introduce malicious code, misuse another person's identity, or use the site to violate law or third-party rights.
10. Availability and liability
We take reasonable care but do not promise uninterrupted website availability. We are responsible for loss that is a foreseeable result of our breach or negligence, subject to applicable law. We do not exclude liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, breach of mandatory consumer obligations, or any liability that cannot legally be limited.
If you buy wholly for business purposes, separate written trade terms may apply. Consumer-only protections do not necessarily apply to business purchases.
11. Privacy and payment security
Our Privacy Policy explains how personal data is used. Card details are submitted directly to Stripe; we receive order, customer, payment-status, and transaction information needed to fulfil and account for the sale, not your full card number.
12. Governing law and disputes
These terms are governed by the laws of the Republic of Kosovo. This choice does not deprive a consumer of mandatory protections of the country where they habitually live when those protections apply. Consumers may bring proceedings in any court available to them under mandatory jurisdiction rules; these terms do not impose exclusive Kosovo jurisdiction on consumers where that would be unlawful.
Please contact us first so we can try to resolve a dispute. Any available public consumer authority or out-of-court mechanism will be identified in the Legal Notice once the selling entity and target markets are confirmed.
13. Changes and contact
We may update these terms for future website use and future orders. A change does not retroactively alter an accepted order unless you agree or law requires it. The effective date above identifies the version.
